KOPIN Corporation and its subsidiaries and affiliates (collectively, “KOPIN”) are responsible for this website, and we are committed to respecting the privacy of visitors. KOPIN has implemented technical, administrative, and physical measures to safeguard any personal information that we may collect.

This Privacy Notice describes our practices related to personal information collected through KOPIN websites. KOPIN defines personal information as any data that relates to an identified or identifiable person.

Binding Corporate Rules

KOPIN has adopted Binding Corporate Rules (BCRs) as a mechanism to authorize the sharing of Personal Information between its businesses inside the European Union (EU) and the UK, and its businesses located in other regions of the world. 

Does this Notice apply to all KOPIN Websites?

This Privacy Notice applies to visitors of KOPIN websites that link to this specific Privacy Notice. Individual websites for KOPIN entities, services and products may adopt different privacy notices because the transactions taking place on those websites may be different. What personal information does KOPIN collect?

Information collected through our website analytics in the US only: KOPIN monitors user traffic patterns throughout the website according to a user’s domain name, browser type, date and time of access, and pages viewed. This information is collected in order to measure the number of visitors to our website and to determine which areas users find useful based upon the traffic to particular areas. KOPIN uses this information to enhance visitors’ experience and to better prepare future content based on the interests of visitors. Note that these analytics are only used for visitors from US locations.

Information collected directly from you: A visitor to our website may be asked to provide personal information to receive a response or some other service from KOPIN. Your personal information will be used for our legitimate interests (where this is permissible) or to fulfill a legal obligation. Where applicable, your personal information may also be used with your consent. 

Where does KOPIN store your information?

Because KOPIN is a global company with locations in many different countries, we may transfer your information from one legal entity to another or from one country to another in order to accomplish the purposes listed above. These countries include, at a minimum, the United States, Scotland, and the United Kingdom. We will transfer your personal information consistent with applicable legal requirements and only to the extent necessary for the purposes set forth above.

KOPIN relies on available legal mechanisms to enable the legal transfer of personal information across borders and ensure an adequate level of protection, as required by law. To the extent that KOPIN relies on Binding Corporate Rules to authorize transfer, KOPIN will comply with those requirements, including where there may be a conflict between those requirements and this Notice. 

Does KOPIN use your personal information to contact you?

KOPIN does not use the personal information collected on this website to contact you except in response to a direct inquiry or if you register for communications in the Investors section of this site.

Does KOPIN share the information it collects with any third parties?

KOPIN may share your Personal Information with our subsidiaries and affiliated companies (the “KOPIN Group”). When KOPIN transfers your Personal Information within the KOPIN Group, it will do so consistent with applicable law and KOPIN’s Binding Corporate Rules, which are available above in many languages.

In addition, KOPIN may provide access to or share Personal Information on an as-needed basis with third parties, such as trusted service providers, consultants and contractors who are granted access to KOPIN facilities or systems, and with government agencies and others as required by law. KOPIN will only share your information outside the KOPIN Group to:

  • allow service providers KOPIN has retained to perform services on our behalf. In those cases, KOPIN will only share the information with service providers for the purposes outlined above. The categories of service providers with which KOPIN may share your Personal Information include (and only where applicable):  companies that may provide you with requested information (such as a public filing); outsourced digital technology providers; and service providers offering software as a service. How long does KOPIN retain personal information?

KOPIN will retain personal information as long as needed to comply with its contractual and legal obligations. If the personal information is not subject to contractual or legal obligations, KOPIN will retain the data for as long as is required for the original purpose for which it was collected.

How does KOPIN use cookies or other tracking technologies?

KOPIN uses cookies on this website. Cookies are small text files sent to and stored on users’ computers that allow websites to recognize repeat users, facilitate users’ access to websites and allow websites to compile aggregate data that will allow content improvements. Cookies do not damage users’ computers or files. If you do not want cookies to be accessible by this or any other KOPIN website, you should adjust the settings on your browser program to deny or disable the use of cookies. The cookies that KOPIN uses on this site do not identify you. The cookies simply provide KOPIN with aggregate, anonymous analytics about the number of people visiting pages on this website.

At the present time, the World Wide Web Consortium (W3C) has not yet established universal standards for recognizable DNT signals, and therefore, the Site and KOPIN do not recognize DNT.

In some instances, KOPIN may provide links to non-KOPIN controlled websites, which KOPIN will make reasonable efforts to identify as such. KOPIN does not control such third-party websites and cannot be responsible for the content or the privacy practices employed by other websites.

What additional information should specific users know?

Parents, guardians, and children: This website is not directed to children and is intended for visitors who are at least 18 years of age and the minimum age for legal consent in their jurisdiction of residence. KOPIN does not knowingly solicit information from, or market products or services to, children. If you do not meet the age requirements set out above, please do not enter your personal information on this or any other KOPIN website.

Residents of California:

California Shine the Light Law: California residents may annually request and obtain information that is shared with other businesses for their own direct marketing use within the prior calendar year. KOPIN does not share your personal information with other businesses for their own direct marketing use.

California Business Contact Information:

If you are a California resident and we receive your Personal Information in the form of contact details from business events, for example as part of a business appointment (e.g., by exchanging business cards) or as part of any other form of collaboration, we may use your contact and business details to maintain our business contacts. For this purpose, we may transfer your contact details to our internal database.  Pursuant to the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA”), you have privacy rights with respect to your business contact Personal Information. 

The processing activity may include the following categories of Personal Information:

  • Your contact information (e.g., name, title, form of address or salutation, address, gender, telephone numbers, email address); and
  • Details on your profession (e.g., job title, position, personnel number, place of work, branch office, department, qualifications).

This data processing is based on our legitimate business interests. We have a legitimate economic interest in maintaining contacts beyond the initial context and in using them to establish and develop a business relationship and to remain in contact with the parties concerned.

Such business contacts could also be easily processed in our email communications with you and then kept in typical business software, either centrally or on the electronic devices of our employees.  

California law provides you with the following rights with respect to your personal information:

  • The right to know what personal information we have collected, used, or disclosed about you.
  • The right to request that we delete any personal information we have collected about you.
  • The right to correct inaccurate personal information about you.

We do not sell or share any of our data subjects’/consumers’ Personal Information, as defined by the CCPA.  California law requires us to identify, for the 12-month period prior to the date of this Privacy Policy, what information we may have “sold” or “shared” about you. For the 12-month period prior to the date of this Privacy Policy, we have not sold or shared any personal information about our business contacts.

Please provide your name, a way for KOPIN to contact you (such as an email address or telephone number) so that we can respond to your request, information about the nature of your relationship with us (for example, are you a visitor to our website or a shareowner), and details about the action that you would like us to take. Based on your request, we will investigate to determine if we have any of your personal information. If we do have your personal information (other than that provided in your request), we will seek to verify your identity based on the personal information that we already have; the data we will request will depend on the nature of the personal information we have about you. Once we verify your identity, we will provide you with a response, indicating how we will satisfy your request or why we cannot comply with your request.

Residents of the European Economic Area, the UK and other countries with privacy laws:

We only use your personal data when the law allows us to. Most commonly, we will use your personal data: (a) where we need to perform the contract we are about to enter into or have entered into with you; (b) where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests; (c) or where we need to comply with a legal obligation. Our legitimate interests are the interests of our business in conducting and managing our business to enable us to give you the best service and/or product and the best and most secure experience. Where we need to collect personal data by law, and you fail to provide that data when requested, we may not be able to fulfil the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us, but we will notify you if this is the case at the time. 

We do not generally rely on consent as a legal basis for processing your personal data although we will get your consent before sending third party direct marketing communications to you via email or text message. You have the right to withdraw consent to marketing at any time by contacting us. 

You have the right to lodge a complaint with the applicable supervisory authority. You also have the right to request access to and correction or erasure of your personal information, seek restrictions on or object to the processing of certain personal information, and seek data portability under certain circumstances. How might KOPIN change this policy?

As KOPIN expands and improves this website, we may need to update this policy. If we make any significant changes to the policy, we will post a notice on our websites or contact you to inform you when required by law. By continuing to interact with us after the modified version of the policy has been posted, you are accepting the changes to the policy, subject to any additional requirements that may apply. We encourage you to review this policy on a regular basis for any changes. The date of the latest version will be identified at the bottom of the policy.
